The Happy Place

Use of the Property & Assumption of Risk

• All visitors use The Happy Place and its facilities at their own risk.
• The Happy Place and its owners will not be liable for injury, loss or damage suffered by any person or dog while using the property, except to the extent that liability cannot lawfully be excluded.
• The Happy Place and its owners are not responsible for the loss, theft or damage of visitors' personal belongings, vehicles or other property, except to the extent that liability cannot lawfully be excluded.
• Visitors acknowledge that The Happy Place is an outdoor, natural environment. Hazards may include, but are not limited to, uneven ground, holes, slippery or muddy surfaces, rocks, tree roots, branches, insects, snakes, wildlife, changing weather conditions, rivers, ponds, other water features and naturally occurring environmental conditions.
• Visitors are responsible for assessing whether the property and its facilities are suitable for themselves, the people accompanying them and their dogs.

Booking Times and Access

• Visitors may enter only during their confirmed booking period and must leave promptly when their booking ends. Early entry, overstaying and use of the property outside the confirmed booking period are not permitted.
• Visitors may not enter an enclosure that is occupied by or booked for another customer.
• Dogs and visitors may use only the enclosure or area allocated to their booking.
• The number of dogs and visitors may not exceed any limits applicable to the booking unless prior permission has been obtained from The Happy Place.
• Any gate code, access code or other access credential issued for a booking is for the authorised customer's use only. Codes may not be shared with people who are not part of the relevant booking or used to gain unauthorised access to the property.
• Visitors must ensure that gates are properly closed and secured when entering and leaving the property.

Responsibility for Dogs

• The person responsible for each dog must supervise the dog at all times, manage its behaviour and take reasonable steps to prevent injury, distress, escape or damage.
• Dogs must not be left unattended anywhere on the property.
• The Happy Place provides fenced areas for private use, but fencing does not replace active supervision. Owners remain responsible for ensuring that their dogs do not escape, dig under fences, jump fences or otherwise leave the designated enclosure.
• Dogs must be kept safely under control when entering or leaving the property and whenever they are outside their booked enclosure. Where appropriate, dogs should be kept on a lead in shared access and parking areas.
• Visitors must not knowingly bring a dog onto the property if the dog is suffering from a contagious or infectious condition that could reasonably pose a risk to other dogs using the property.
• Reactive, nervous or behaviourally sensitive dogs are welcome. However, owners remain responsible for understanding their dog's behaviour and for taking appropriate precautions to protect their dog, other people and other animals.
• Dogs must not be mistreated, deliberately provoked, left in distress or knowingly exposed to unsafe conditions. Owners must provide appropriate supervision, drinking water from the provided water point and suitable care throughout their visit.

Cleaning Up After Dogs

• Visitors are responsible for cleaning up promptly after their dogs and leaving the enclosure clean and ready for the next visitor. All dog waste must be collected, securely bagged and placed in the municipal refuse bin situated on the pavement next to the main entrance gate.

River, Pond and Water Features

• Where dogs or visitors have access to the river, pond or any other water feature, owners accept responsibility for supervising their dogs around the water and assessing their dog's swimming ability, health and individual risks.
• Water levels, currents, depth, water quality and surrounding conditions can change without notice. Drowning, slipping, injury and other water-related risks are possible.
• The Happy Place does not guarantee the quality or safety of water in natural water features. Visitors must decide whether it is appropriate for their dogs to enter or drink from natural water sources.

Children and Guests

• Children must be supervised by a responsible adult at all times. The person making the booking is responsible for ensuring that all people accompanying them comply with these Terms and Conditions.

Damage to the Property

• Visitors may be held responsible, where legally justified, for damage caused by their actions or by the actions of anyone or any dog in their group.
• This includes damage to fences, gates, locks, access-control equipment, dog equipment, vegetation, water facilities, signage and other property belonging to The Happy Place.
• Any damage, broken fencing, malfunctioning gate, dangerous condition or other safety concern noticed during a visit should be reported to The Happy Place as soon as reasonably possible.

Behaviour and Safety

• The Happy Place reserves the right to refuse entry, terminate a visit or require a person to leave where that person:
  • breaches these Terms or park rules;
  • behaves dangerously or irresponsibly;
  • deliberately damages the property;
  • interferes with other visitors;
  • mistreats an animal;
  • creates an unreasonable risk to people, dogs or property; or
  • refuses to comply with a reasonable safety instruction from The Happy Place.
• Where a visit is terminated because of a material breach of these rules, no refund or booking credit will ordinarily be provided, subject to applicable consumer law.
• Visitors may not interfere with wildlife, vegetation, fencing, gates, electrical equipment or other infrastructure on the property.
• Fires, fireworks, weapons and any activity that creates an unreasonable fire or safety risk are prohibited unless expressly authorised by The Happy Place.

Closure of the Property

• The Happy Place may temporarily close all or part of the property where reasonably necessary because of maintenance, flooding, severe weather, fire risk, damage, safety concerns, access problems, utility failure or another circumstance affecting the safe operation of the property.
• Where The Happy Place cancels a booking because the booked area cannot reasonably be made available, the customer will ordinarily be offered the choice of rescheduling, receiving an equivalent booking credit, or receiving a refund of the amount paid for the affected booking.

Cancellation and Refund Policy

• Because each booking reserves an enclosure exclusively for the customer for a specific period, cancellations at short notice may prevent the time slot from being booked by another customer.

More Than One Hour Before the Booking

• Bookings cancelled more than one hour before the scheduled start time may be cancelled and the customer will receive a booking credit.
• Booking credits are not redeemable for cash.

Less Than One Hour Before the Booking

• Bookings cancelled less than one hour before the scheduled start time will not qualify for a refund or booking credit, as the reserved time slot is unlikely to be filled at such short notice.

No-Shows

• Customers who do not arrive for their booking and have not cancelled within the permitted cancellation period will not receive a refund or booking credit.

Late Arrivals

• Arriving late does not extend the booking period. The booking will still end at the originally scheduled time to ensure that the next customer's booking is not affected.
• No refund or booking credit will be provided for time lost because of late arrival.

Bad or Severe Weather

• The Happy Place is an outdoor facility, and bookings remain valid during rain, wind, cold, heat and other ordinary or adverse weather conditions.
• If The Happy Place remains open and a customer chooses not to attend because of the weather, no refund or booking credit will be issued.
